Terms of Service

1. Acceptance of Terms
By accessing or using PaceForms (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms apply to all users, including form builders and developers using our API.
2. Description of Service
PaceForms provides:
- → A visual form builder that allows you to create and publish forms without code
- → A form backend API that handles submissions from your own HTML forms
- → A submissions database that stores and organises all form responses
- → Integrations with third-party services (Google Sheets, Slack, Airtable, etc.)
3. Account Registration
You must provide accurate, complete information when registering. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access at support@paceforms.com.
One person or legal entity may not maintain more than one free account. You must be at least 16 years old to use the Service.
4. Acceptable Use
You agree not to use PaceForms to:
- ✗ Collect data illegally or without proper consent from your form respondents
- ✗ Send spam or use forms for mass unsolicited communications
- ✗ Collect sensitive personal data (health, financial, government IDs) without appropriate safeguards
- ✗ Reverse-engineer, decompile, or attempt to extract the source code of our Service
- ✗ Overload or disrupt our infrastructure (DDoS, credential stuffing, scraping)
- ✗ Violate any applicable laws or regulations
- ✗ Resell or sublicense our Service without written permission
We reserve the right to suspend or terminate accounts that violate these rules without notice.
5. Data Ownership
You own your data. All forms you create and all submissions collected through your forms belong to you. We process submission data on your behalf as a data processor. You remain the data controller responsible for how you collect and use your respondents' data.
You can export or delete all your data at any time from your account dashboard or via API. We do not claim any intellectual property rights over your forms or submission data.
6. Payment and Billing
Paid plans are billed monthly or annually in advance. All prices are listed in USD and exclude applicable taxes. You authorise us (via Stripe) to charge your payment method on each renewal date.
If a payment fails, we will retry for 7 days before downgrading your account to the free plan. We do not offer refunds for partial months, but we do offer a 14-day money-back guarantee on new paid subscriptions.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you retain access until then.
7. Service Availability
We aim for 99.9% monthly uptime for paid plans. We perform scheduled maintenance with advance notice where possible. We are not liable for downtime caused by third-party providers, internet infrastructure, or circumstances beyond our reasonable control.
8. Limitation of Liability
To the maximum extent permitted by law, PaceForms is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or goodwill, arising from your use of or inability to use the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or harmful components.
10. Termination
You may close your account at any time via account settings. We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination so you can export it, then delete it permanently.
11. Changes to Terms
We may modify these Terms from time to time. We will provide at least 14 days' notice of material changes via email. Continued use of the Service after that date constitutes acceptance of the revised Terms. If you do not agree, you may close your account before the changes take effect.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, unless local consumer protection laws in your jurisdiction provide otherwise.
